PUTTING THE “RIGHT” BACK IN ‘COPYRIGHT’:  EDUCATING PRINCIPALS IN COPYRIGHT LAW

REGARDING CLASSROOM USE OF MATERIALS
An educator may copy:
An educator may not copy:
·          One chapter from a book
·          A newspaper or periodical article
·          A poem less than 250 words; for longer poems a 250 word except may be copied
·          Excerpts from music or literature that make up less than 10% of the entire work
·          Prose less than 2500 words; for longer prose excerpts of 1000 words or 10%, whichever is less
·          A chart, illustration or picture from a book or periodical (multiple copies permitted)
·          Make copies of consumable works (e.g. workbook pages)
·          Create anthologies of varied works or copy the same works for multiple semesters or years
·          Make copies of articles from the same newspaper from week to week
·          Copy the same work more than nine times in a single semester
·          Use copyrighted work for commercial purposes
·          Copy a special work in its entirety
 
REGARDING RECORDED TELEVISION PROGRAMS
An educator may show a recorded television program if:
An educator may not:
·          The show was originally broadcast to the general public
·          The showing takes place within the first 10 consecutive school days after the recording is made
·          The educator destroys the videotape 45 days after the tape is made
·          Alter the tape of the original
·          Use the tape between the 19th and 45th days for anything other than teacher-evaluation purposes
REGARDING EDUCATIONAL USE OF MUSIC
An educator may create and use:
An educator may not:
·          Multiple copies of sheet music for an imminent performance to replace purchased copies that are not available
·          Excerpts of a work used for academic purposes that make up no more than 10% of the original work
·          A single copy of a sound recording of copyrighted music for creating music exercises
·          A single recording of a student performance for evaluation or rehearsal purposes
 
·          Copy to create, replace or substitute for collective works
·          Copy for the purpose of a performance (unless it is an emergency)
·          Copy as a substitute for purchase
REGARDING WEBSITE CONTENT
An educator may:
An educator may not:
·          Post his/her own work or a student’s original text, artwork or graphics
·          Post any material for which they have acquired a license
·          Use any text or picture that is clearly designated ‘public domain’ or ‘available for free use’
·          Create a hyperlink on a website to another website’s main page
 
·          Use any text or picture that the educator knows is copyright protected and is not ’public domain’ or ‘available for free use’
·          Create a hyperlink that displays information from another website inside a frame on the educator’s website
 
REGARDING THE USE OF SOFTWARE
An educator may:
An educator may not:
·          Make one back-up of software
·          Load software on more than one computer if the license does not permit multiple copying
An educator should always credit the author of the work whether it is him/herself, a student or a third party.
